1. Acceptance of Terms
By accessing or using KorPush ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. "You" refers to any individual or entity using our services.
2. Description of Service
KorPush provides a web push notification management platform that allows website owners ("Publishers") to: collect push notification subscriptions from their website visitors, segment subscribers by geographic location (country, state, city), device type and browser, send push notification campaigns to subscribers, and review campaign analytics. We reserve the right to modify or discontinue the service at any time with reasonable notice.
3. Registration and Account
- You must provide accurate and complete registration information.
- You are responsible for maintaining the security of your account credentials.
- Each account is for a single user or entity. Sharing access is prohibited.
- You must notify us immediately of any unauthorised account access.
4. Publisher Obligations
As a Publisher, you agree to:
- Obtain valid, informed consent from your website visitors before enrolling them as push subscribers, in compliance with applicable laws (GDPR, CCPA, etc.).
- Provide visitors with a clear opt-out mechanism and honour all unsubscribe requests promptly.
- Not use KorPush to send illegal, deceptive, harmful, or unsolicited push notifications.
- Comply with all applicable data protection laws regarding visitor personal data.
- Maintain an up-to-date and accurate Privacy Policy on your website that discloses your use of push notifications.
5. Prohibited Uses
You may not use KorPush to:
- Send spam, phishing content, or malicious payloads.
- Collect subscriber data without proper consent.
- Impersonate another service, brand, or individual.
- Attempt unauthorised access to our systems or other users' data.
- Violate any applicable federal, state, local, or international law.
6. Intellectual Property
The KorPush name, logo, dashboard, software and documentation are the intellectual property of KorPush. You may not copy, modify, distribute, or create derivative works without our written consent.
7. Data and Privacy
Our collection and use of personal data is governed by our
Privacy Policy. Where you use KorPush to process your subscribers' data, a Data Processing Agreement (DPA) applies — see our
GDPR / DPA page.
8. Limitation of Liability
To the maximum extent permitted by law, KorPush shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our aggregate liability for any claims shall not exceed the greater of (a) the total fees paid by you in the 12 months preceding the claim, or (b) USD $100.
9. Indemnification
You agree to indemnify and hold KorPush harmless from any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
10. Termination
We may suspend or terminate your access to KorPush immediately if you breach these Terms or use the Platform in a way that poses a legal or reputational risk to us. Upon termination, your right to use the Platform ceases immediately.
11. Changes to Terms
We may update these Terms from time to time. The updated version will be noted by the "Last updated" date. Your continued use after changes constitutes acceptance.
12. Governing Law
These Terms shall be governed by applicable law. Any disputes shall be resolved through good-faith negotiation first, then binding arbitration.
